OPRA - police officer-involved lawsuits 2012-2019

We're waiting for Taeho Kim to read recent responses and update the status.

Dear Flemington Borough,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.

Records requested:

1. A list of all lawsuits and cases in which any officer of the police department was involved between 2012 and 2019. For each lawsuit/case, please provide the date (month and year) of the alleged incident at issue, whether the alleged incident was excessive force, settlement amount (if any), and final compensation amount ruled (if any).

2. Please provide copies of the complaint in any lawsuits and cases described in above.

Filed 6/9/14: Dennis Shuman vs. Raritan Townshp et al. US District court -
3:14-cv-03658-FLW-LHG Claims excessive use of force.

Dismissed concerning Flemington officer Godown on 11/30/2016, as barred by
qualified immunity.

Filed 9/30/19: Richard Giffen et al vs. Borough of Flemington. US District
Court - 3:19-cv-18454-FLW-DEA. Claims civil rights violations and
malicious prosecution. Pending.

Filed 12/3019: Tony D's Enterprise Driving School vs. Susanna J Peters,
Michael Mariaschin, and NJ Manufacturers Insurance Co. - Superior Court of
NJ Law Division, Hunterdon County Special Civil Part. Docket No.
HNT-DC-002023-19. Concerned officer's investigation at an accident scene.
Dismissed 2/11/20 for failure to state a claim upon which relief may be
granted.

The complaints for these cases are attached. This completes my production
of documents for this request. Thank you -
