Response to this request is long overdue. By law, under all circumstances, Livingston Township should have responded by now (details). You can complain by requesting an internal review.

This is a request for public records under the Open Public Records Act (OPRA) and the common law right of access. Please acknowledge receipt of this message.

Records requested:

All communications, including emails, text messages, phone call records, official police department records, and recordings, between October 31, 2023, and December 1, 2023, related to:

1. Requests for police protection by Town Council members or their families
2. Concerns about safety expressed by Town Council members or their families
3. Any additional police overtime expenses incurred due to these requests
4. References to comments made on the Facebook page at LivingstonCares.com causing fear or safety concerns for the Town Council or their families.

These records should include, but are not limited to, communications involving Mayor Michael Vieira, Councilman Meinhardt, Councilman Klein, other elected officials, and the Livingston Police Department.

Please provide these records electronically. If any records are withheld or redacted, please cite the specific OPRA exemption applied.

I am writing to request clarification regarding the redactions made to the records I received in response to my recent OPRA request. Specifically, the redactions in the Vaughn Index were claimed to be due to “attorney-client privilege”. However, I noticed that there is no attorney copied on any of the text messages provided.

According to OPRA guidelines, an explanation for the exemption must be provided, and an unexplained claim of attorney-client privilege is insufficient. Could you please provide a more detailed justification for each of these redactions, including how attorney-client privilege applies in each case.
