Good Afternoon, Mr. Rossi. We have received your requests regarding these records. The Board of Fire Commissioners has concerns regarding your request. We have submitted an official inquiry to the New Jersey Government Records Council. Once we get an official determination, we will advise you accordingly. Thank you for your patience with this matter. Regards Brian

Dear Mr. Kubiel:
I have had the opportunity to review your response to this request with my legal counsel as well as the letter sent to the New Jersey Government Records Council regarding the same.
We are taking the position that it is unacceptable to leave this OPRA request open indefinitely while District 1 waits to receive clarification from the GRC. The 7th business day following the submission of my request came and went on Friday, April 26th, 2019.
We need to set a specific date in which a response will be provided that is not contingent on the informal clarification you have requested from the GRC. OPRA requires a specific date and does not authorize indefinite extensions such as the one at issue in District 1's response to this request.
Therefore, I would like to set the deadline for a formal response to this request of Wednesday, May 1st, 2019 by close of business, which would be a full 10 business days from the date of submission of my original request.
If I do not receive a sufficient response by that date, or other arrangements are made, I will assume that the request has been deemed denied and will proceed accordingly.
Yours sincerely,
Gavin Rozzi
I will be out of the office from Thursday, April 25, 2019 and returning on
Wednesday, May 1, 2019. I will have very limited access to telephone and
e-mail. If you need immediate assistance, please contact the
administration office at (732) 341-4441.
To whom it may concern:
The following message is for Peter Van Dyke, Esq. regarding Toms River
Fire District 1. I sent the following message to Brian Kubiel but received
a message indicating he is going to be out of the office this week. I am
copying it below as it is time sensitive that this be addressed before
Wednesday.
