Pursuant to OPRA, I am requesting copies of the following public documents, contracts and records together with an amendments, attachments and exhibits that pertain to the following:

The selection, award and expenditure of federal and state public funds by the NJ Department of Human Services (DHSS) and/or the NJ Department of Health (DOH) of the New Jersey Institute of Technology (NJIT) and the New Jersey Innovation Institute (NJII) and its' affiliates, subsidiaries and other "for-profit-entities" owned and/or operated by NJII or NJIT that relate in any way to the arrangement, agreement and/or selection of NJII and NJIT to be paid said state or federal monies for the development, operation, management and support of the the New Jersey Health Information Network (NJHIN or NJ-HIN).

This will OPRA request also applied to all emails, correspondence and memorandum of understanding between DOH, DHSS, NJIT and NJII that pertains to the Scope of Work, Deliverables and Work/Production Performance related to the development, operation and performance of the NJ-HIN.

Copies of any messages, emails, letters, reports and / documents set by the DOH, DHSS to any federal agency regarding the development, operation and performance of NJIT, NJII and NJ-HIN

Dear Requestor:

The referenced request for " all emails, correspondence and memorandum of understanding between DOH, DHSS, NJIT and NJII that pertains to the Scope of Work, Deliverables and Work/Production Performance related to the development, operation and performance of the NJ-HIN." records is improper. The request is overbroad, nonspecific, and unduly burdensome in that it would require the custodian to conduct research and exercise discretion.

Therefore, the government records law, N.J.S.A. 47:1A-1 et seq., obliges me to deny the request. You have the right to appeal this determination in accordance with applicable law.
