Good afternoon,

Your request requires further clarification. Your request sought “emails between Ms. Chari Chanley (As Principal) and the MTMS PSA, PTO, PTA Dated 2016-2020. Subject and/or Keywords: PSA, PTO, PTA, merchandise, event, fundraiser, money, distribution, pickup, shirts, signs, vendor, approval, meeting, discussion, principal.” Please be advised that the District is unaware of a specific e-mail address for the MTMS PSA, PTO, or PTA. If our understanding is incorrect, kindly provide the appropriate e-mail address. If it is not, the District needs clarification on the specific individual or representative from the MTMS PSA, PTO, or PTA that you are seeking the requested communications so that the District can locate the responsive records. A proper request under OPRA must identify with reasonable clarity those documents that are desired. See Bent v. Stafford Police Department, 381 N.J. Super. 30, 37 (App. Div. 2005). In particular, OPRA “is not intended as a research tool litigants may use to force government officials to identify and siphon useful information. Rather, OPRA simply operates to make identifiable government records ‘readily accessible for inspection, copying, or examination.’ N.J.S.A. 47:1A-1.” MAG Entm't, LLC v. Div. of Alcoholic Beverage Control, 375 N.J. Super. 534, 543 (App. Div. 2005). As a result, your request is denied, at this time, until further clarification is provided.

Good afternoon,

The Board is in receipt of your Open Public Records Act ("OPRA") request. Your request requires additional time to respond due to the significant demands placed on the District with regard to the COVID-19 pandemic and OPRA requests, the complexity of the request, and the number of potentially responsive records. OPRA allows custodians to seek extensions of time pursuant to N.J.S.A. 47:1A-5(i). Specifically, OPRA states that "the requestor shall be advised by the custodian when the record can be made available. If the record is not made available by that time, access shall be deemed denied." Accordingly, your request requires an extension of time until April 25, 2022.

Dear Reeshemah Zielinski,
Please confirm if the duplicates emails are being removed in your original discovery. It is unlikely there would be 10K emails in a period of 4 years regarding the PSA/PTO. In order to simplify the request and make it less "labor intensive" please provide email logs for the recipients/senders requested for the period listed. The logs should include date, to/from, subject.

Yours sincerely,

Monroe BOE Watchdog
