Dear Anonymous Bob,

The West Windsor-Plainsboro Regional School District Board of Education
(“Board”) was closed Thursday, Nov. 27 and Friday, Nov. 28, 2025, for
Thanksgiving Recess. As such, your OPRA request which was sent via
OPRAMachine at 9:16 p.m. on Wednesday, Nov. 26, 2025, was received on
Monday, Dec. 1, 2025.  Accordingly, the seven business day timeframe for
responding to your request is Dec. 10, 2025. This response is being
provided to you within the seven-business day time frame for a response.  

OPRA defines a “government record” of a public entity as “any paper,
written or printed book, document, drawing, map, plan, photograph,
microfilm, data processed or image processed document, information stored
or maintained electronically or by sound-recording or in a similar device,
or any copy thereof, that has been made, maintained or kept on file in the
course of his or its official business.” N.J.S.A. 47:1A-1.1. Accordingly,
the Board is required to produce only those records which it maintains in
the official course of business and which are not otherwise exempt from
production. Pursuant to the definition of a government record, a public
entity is not required by OPRA to research information and/or create
records that do not exist in response to OPRA requests. See e.g., Mag
Entertainment, LLC v. Division of Alcoholic Beverage Control, 375 N.J.
Super. 537 (App. Div. March 2005).

Your Request and the Board’s response follow. 

Request: “All emails, letters and any form of communication sent and
received from Micheal Rosa to South Brunswick Schools and Jake Konopaka
regarding Basketball and Matt Rosa”

Response: The above request is invalid and has been denied. As per the new
provisions of OPRA, “A custodian shall not be required to complete a
request, including for, but not limited to, mail, email, text messages,
correspondence, or social media postings and messages, if the request does
not identify a specific job title or accounts to be searched, a specific
subject matter, and is not confined to a reasonable time period, or if the
custodian determines that the request would require research and the
collection of information from the contents of government records and the
creation of new government records setting forth that research and
information. It shall be sufficient for a requestor to identify specific
individuals by the individual’s job title and position.” The portion of
the Request for communication related to “South Brunswick Schools” does
not identify a specific recipient. The Request for communication also does
not include a date range. 

Since the Request noted above was submitted anonymously, you are
prohibited from instituting a proceeding in either the Superior Court of
New Jersey or with the Government Records Council to challenge the
decision by the District to deny immediate or any other access. See
N.J.S.A. 47:1A-5 and N.J.S.A. 47:1A-6. You may contact the GRC by
