- A list of all the individuals’ names and addresses who have been arrested in the city for the month of September 2022.

Dear Nathan,

This comes in response to your OPRA Request for:

"- A list of property addresses that have received any code violations
since the beginning of the year. Please provide the type of violation.

risk of condemnation, etc) - Please find attached the list of UCC
violations provided by the Building Department in response to your
request.

- A list of all property addresses that are currently vacant, abandoned,
or boarded up. - The Township does not make, maintain or keep on file a
list of vacant, abandoned or boarded up properties

-  A list of all the individuals’ names and addresses who have been
arrested in the city for the month of September 2022.-The Township does
not make, maintain or keep on file the list of individuals' names and
addresses who have been arrested within the Township. Per OPRA, the
custodian is under no obligation to create a record that has not been
created at the time of an OPRA request.  (See Goeckel v. Chatham Borough
PD, GRC Complaint No 2013-345 (July 2014), as well as Blau v. Union County
GRC Complaint No. 2003-75 (January 2005), Paff v. v. Neptune Twp Housing
Authority GRC Complaint No. 2010-307 (Interim Order dated April 25, 2012),
Delbury v. Greystone Park Psychiatric Hosp., GRC Complaint No. 2013-240
(Interim order dated April 29, 2014).

However, the Police Department has advised that they can provide the
individual arrest reports during the month of September 2022.  Please
respond to this email and acknowledge for us to move forward and review
the arrest reports for redactions,  which will require a two week
extension until October 20, 2022.
As this document is being emailed to you there is no cost for duplication
under the Open Public Records Act.

Pursuant to NJSA 47:1A-5(i), you shall receive a response in no more than seven (7) business days, with day one starting the day after the request has been received. (Holidays and Townhall closings do not count as business days).

Dear Nathan,

This comes in response to your follow up request on October 7, 2022  for
 "all individual arrest reports during the month of September 2022".

Please see the responsive arrest reports attached which have been redacted
pursuant to NJSA 47:1A-1, in which a public agency has a responsibility
and an obligation to safeguard from public access a citizen's personal
information with which it has been entrusted when disclosure thereof would
violate the citizen's reasonable expectation of privacy, and therefore
birth dates, emails, and phone numbers have been redacted. Pursuant to
NJSA 47:1A-1.1, driver license numbers and social security numbers have
been redacted.  Pursuant to Executive Order #69 and # 9 fingerprint cards,
plates and photographs and similar criminal investigation records that are
required to be made shall not be deemed to be public records and subject
to inspection, and therefore mug shots have been redacted.

The Police Department has informed us that one arrest report involves a
juvenile, and is therefore exempt under NJSA 2A-4A-602A:4A-60  (Disclosure
of juvenile information; penalties for disclosure.).  Also, please be
advised that there are approximately 20 arrest reports currently in review
and cannot be released at this time under NJSA 47:1A-1.1, as inter-agency,
intra-agency advisory, consultative and deliberative records. Please
submit another OPRA request at a later date and we will provide whatever
arrest reports are available at that time.
