As stated in the NJDEP's response, Request Item # 1 was denied on the basis that it requires the NJDEP to conduct research & correlate data, and then create a record that does not exist; all of which is not required pursuant to N.J.S.A. 47:1A-9 & Mag Entertainment v. Div. of Alcoholic Beverage Control 375 N.J. Super 537 (App. Div. 3/05). The NJDEP maintains no such list that relates projects to Black History nor is such a list required by law or regulation to be made or maintained.
