I have reviewed your request for the following records:

Please be advised that the portion of your OPRA request for employees and officials broken down by who is covered by health benefit plans or receives reimbursements for health insurance is denied based on the following:
OPRA and its case law provide that records pertaining to individual health benefits information are exempt from disclosure pursuant to OPRA, the State Health Benefits Plan regulations, and/or HIPAA. To that end, cases have held that information pertaining to whether someone receives health benefits or not (i.e., whether they elect or forego benefits), the insurance plan selected/level of coverage, and individual health insurance cost or value of waiver, is exempt. See Kleinz v. Atlantic Cape Community College, GRC Complaint No. 2020-161 (Interim Order November 9, 2021); see also, Palkowitz v. Hasbrouck Heights (Bergen), GRC Complaint No. 2013-199 (Interim Order dated February 25, 2014); Brown v. Ocean City Board of Education, GRC Complaint No. 2011-271 (Final Decision January 29, 2013).
I have attached a copy of the Township contracts that cover health insurance and reimbursements. I have also attached a copy of the health insurance plans offered to covered employees.
