For the last four years, data tables of DEFENDANTS WITH INDICTMENTS/ACCUSATIONS DISPOSED BY OFFENSE CATEGORY AND MANNER OF DISPOSITIO
Dear Monmouth County Prosecutor's Office,
This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:
For the last four years, data tables of DEFENDANTS WITH INDICTMENTS/ACCUSATIONS DISPOSED BY OFFENSE CATEGORY AND MANNER OF DISPOSITION
Yours faithfully,
Theodore P. Cross
Your request is not a valid OPRA request and must be denied. See Simmons v. Mercado, 247 NJ 24 (2021), Paff v. Galloway Twp., 229 NJ 340 (2017), and MAG Entertainment, LLC v. Division of Alcoholic Beverage Control, 375 N.J. Super. 534 (App. Div. 2005).
"A records request must be well defined so that the custodian knows precisely what records are sought. The request should not require the records custodian to undertake a subjective analysis to understand the nature of the request. Seeking particular information from the custodian is permissible; expecting the custodian to do research is not." Paff v. Galloway Twp., 229 NJ 340, 355 (2017).
Your request for 4 years of data tables of DEFENDANTS WITH INDICTMENTS/ACCUSATIONS DISPOSED BY OFFENSE CATEGORY AND MANNER OF DISPOSITION is overly broad and unclear. What do you mean by "disposed by offense category"? What do you mean by "manner of disposition"? Please be more specific. The requestor must "describe[] the records sought with the requisite specificity and narrow[] the scope of the inquiry to a discrete and limited subject matter." Simmons v. Mercado, 247 NJ 24 (2021) citing Burke v. Brandes, 429 NJ Super 169 (App. Div. 2012).
At this time I cannot produce any records because it is unclear what data or information you are requesting.
