Dear Montclair Township,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:
1. Documents showing the total number of Firearms Purchaser ID cards issued by Metuchen per calendar year (2021, 2022, 2023, 2024, 2025 to date).

2. Documents showing the total number of handgun purchase permits issued by Metuchen per calendar year (2021, 2022, 2023, 2024, 2025 to date).

Note: I am NOT requesting personally identifying data. I simply request documentation showing aggregate numbers by calendar year. See N.J.S.A. 47:1A-1.3 ("aggregate information regarding the total number of permits to purchase a handgun and firearms purchaser identification cards, without any personal identifying information" is a government record).

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

granting access, denying access, seeking clarification, or requesting an extension of time
within the statutorily mandated seven (7) business days.

Commercial Purpose (exception)

Effective September 3, 2024: If the requestor is seeking records for a “commercial purpose” as
defined in N.J.S.A. 47:1A-1.1, where the response time frame is fourteen (14) business days,
but the custodian shall notify the requestor of the additional time within seven (7) business
days. N.J.S.A. 47:1A-5(i).

Daniel’s Law (exception)

Effective September 3, 2024: If the requestor is seeking records requiring review for
compliance with “Daniel’s Law” (N.J.S.A. 47:1B-1, et seq.), where the response time frame is
fourteen (14) business days, but the custodian shall notify the requestor of the additional
time within seven (7) business days. N.J.S.A. 47:1A-5(i).

As an exception to the typical response time frame, P.L. 2020, c.10, enacted on March 20,
2020, N.J.S.A. 47:1A-5(i) provides that the statutory time frame shall not apply during a
state of emergency, public health emergency, or state of local disaster emergency.

FARS, and the current digital FARS application does not
present that information in a document or record. OPRA does
not require that we create a record to answer questions posed,
and after many attempts to try to get FARS to present the
information in such a fashion, we were unsuccessful. Perhaps
in a future version of FARS, or by requesting such information
from the NJSP who manage FARS, the information you seek may be
available. Again, as we do not maintain a separate log or
ledger of applications beyond FARS indicating the number of
FID and pistol permits, we do not have a record that answers
your questions.
