Dear Spring Lake Heights Borough,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

I am in receipt of your Open Public Records Request dated September 18,
2024 for the following: 

 1.) Vendor activity report - in detail for the years 2019-2024 YTD.  In
detail, by year individually;  see attached

 2) Payroll report by employee for the years 2019-2024.  Year end report,
by year please; I request that you clarify the exact information that you
want as there are numerous reports that could be considered payroll
reports. 

Pursuant to the requirements of N.J.S.A. 47:1A-1 et seq (hereinafter “Open
Public Records Act” or OPRA) we herewith provide the following response to
your Open Public Records Act Request.  Please note that the Custodian of
the Records has sought and is producing only those records defined as
follows: 

“Government record” or “record” means any paper, written or printed book,
document, drawing, map, plan, photograph, microfilm, data processed or
image processed document, information stored or maintained electronically
or by sound-recording or in a similar device, or any copy thereof, that
has been made, maintained or kept on file in the course of his or its
official business by any officer, commission, agency or authority of the
State or of any political subdivision thereof, including subordinate
boards thereof, or that has been received in the course of his or its
official business by any such officer, commission, agency, or authority of
the State or of any political subdivision thereof, including subordinate
boards thereof”.

The item attached specifically addresses what the Records Custodian
believes to be responsive to request #1.  

Please be advised that N.J.S.A. 47:1A-6 provides that a person who is
denied access to a government record by the custodian of the record, at
the option of the requestor, may institute a proceeding to challenge the
custodian's decision by filing an action in Superior Court which shall be
heard in the vicinage where it is filed by a Superior Court Judge who has
been designated to hear such cases because of that judge's knowledge and
expertise in matters relating to access to government records; or in lieu
of filing an action in Superior Court, file a complaint with the
Government Records Council established pursuant to N.J.S.A. 47:1A-7.

The right to institute any proceeding shall be solely that of the
requestor. Any such proceeding shall proceed in a summary or expedited
manner. The public agency shall have the burden of proving that the denial
of access is authorized by law. If it is determined that access has been
improperly denied, the court or agency head shall order that access be
allowed. A requestor who prevails in any proceeding shall be entitled to a
reasonable attorney's fee.

Dear Gillis, Janine,

The vendor report you sent was “condensed”. My initial request was for “in detail”. Please resend the reports for each year clicking the Detail drop down, not Condensed.

Payroll report is simply the Last payroll check register report by employee. Like the Payroll check register by employee for the second payroll in December of each year requested.

Please advise if you need a step by step guide as to how to run these reports in your Edmunds software or your Payroll software. I would be happy to help.
