Dear Mr. Zweibel,
As I understand a subordination agreement, it appears to be that you
believe the Town of Secaucus provided funds to this project in the form of
a grant and or loan.
Neither the Town of Secaucus nor its Affordable Housing Board played any
role in the financing of this property. The only thing I know, is that
Hudson County Divisions of Housing & Community Development, may have
provided the developer with HOME funds, which is why you see on the DEED
Restriction the mention of Floating Home Units.
The Town of Secaucus does not have any subordination agreements with the
developer.

I understand the township was not involved in the financing of his property. However, lenders at times, and require townships to sign a subordination agreement with respect to the affordable deed restriction on the property. Can you please confirm that no subordination agreements were executed by the township?

Dear Mr. Zweibel:
I have checked with both James Burke, Esq. and Bill Snyder, Administrator
for the Affordable Housing Board.
Both have indicated to me via email that there was no subordinate
agreement. If there had Bill Snyder (who signature is on the Deed
Restriction) would have been part of that negotiation.
