Environmental Testing of Library
Dear East Brunswick Township,
This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.

-Engineering Department - Environmental Pre-Testing Results, Demolition Reports and Permits for Library building 2019 onwards
-Library - All Environmental testing (contact/surface and air) of all contaminants (silica, aerosolized mold, asbestos, etc.); all proposals, recommendations, and reports from all consultants for environmental testing; all reports and correspondence from the State of NJ regarding and environmental issues; contracts for renovation of library 2019 onwards
-Library Director - All correspondence regarding above issues 2019 onwards, including BOTH sets of consultants
-Mayor - All correspondence regarding above issues 2019 onwards

Good afternoon Ms. Miller,
Please note that In response to your OPRA request dated March 14, 2023, we are requesting additional time beyond the seven (7) business days to fulfill. OPRA allows custodians to seek extensions of time pursuant to N.J.S.A. 47:1A-5.i. Specifically, OPRA states that, "the requestor shall be advised by the custodian when the record can be made available. If the record is not made available by that time, access shall be deemed denied."
Your request requires an extension of time until April 3, 2023 so that the department can put the requested documents together.

I would like correspondence from November 2021 through March 2023 regarding the renovation of The Library, including anything regarding permits, pre-project environmental testing (including Engineering Dep and/or contracted vendors), and regarding the testing of materials (surface and air) once the State was involved, the decision on closing, and subsequent cleaning/re-opening of the library in 2023.

Dear Anabela Da Silva, thank you for this important information for the public.
On page 2, “snapshot of results” on Page 13 is over-redacted.
The type of test performed is cropped off, as is the full table showing results and text below.
You cannot tell what test was performed, and what all of the findings are.
It is therefore over redacted, which shows non-compliance with access through OPRA records.
For example, as with results on Page 12 from EMSL, identifying information is only on the top portion of the page, which an be easily cropped, and the bottom lists analysts and lab manager.
As Dir. James Arthur stated on Page 2, all information should be provided to the public (and that requests such as mine would likely happen). While protecting who submitted the test is important, this shows incomplete information.
