Dear New Jersey Department of Education,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

Number of professional employees promoted from the salary range 28 to range 30 from January 2023 to present day. I would like, to the extent possible, a list: by position/title (including subtitles), the division and office, their last step in range 28 and first step in range 30, the date the promotion was submitted, and the effective start date of the new title. I would like employee names and any other identifying information to be redacted. This may be in an already existing list or separate files for each employee. Partial response is fine if all information is not available.

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Regarding your request for “the date the promotion was submitted”, please
note that custodians are not required to create records in response to a
request, pursuant to MAG Entertainment, LLC v. Division of Alcoholic
Beverage Control, 375 N.J.Super. 534 (App. Div. 2005). Additionally, OPRA
does not require custodians to research files to discern which records
might be responsive to a request. Custodians have no legal duty to conduct
research to locate records responsive to OPRA requests pursuant to the
Superior Court’s decisions in MAG Entertainment, LLC v. Division of
Alcoholic Beverage Control, 375 N.J. Super. 534 (App. Div. 2005), Bent v.
Stafford Police Department, 381 N.J. Super. 30 (App. Div. 2005), New
Jersey Builders Association v. New Jersey Council of Affordable Housing,
390 N.J. Super. 166 (App. Div. 2007) and the Government Records Council’s
decision in Schuler v. Borough of Bloomsbury, GRC Complaint No. 2007-151
(March 2008). Accordingly, this part of your request is denied.
