Emails with DEVCO and Langan Engineering Since 6/1/19

Response to this request is long overdue. By law, under all circumstances, New Brunswick Board of Education should have responded by now (details). You can complain by requesting an internal review.

Dear New Brunswick Board of Education,

Under OPRA and common law right of access, please provide copies of all emails or other written correspondence between Board of Education officials and representatives of either New Brunswick Development Corporation (a/k/a DEVCO) and/or Langan Engineering during the time period of June 1, 2019 through the present day.

Yours faithfully,

Charlie Kratovil

Richard Jannarone, New Brunswick Board of Education

Mr. Kratovil, I am in receipt of your request below dated February 12th.
Due to the volume of the documents generated in response to your request
the Board requires additional time beyond the seven business days to
respond. OPRA allows custodians to seek extensions of time Pursuant to
N.J.S.A. 47:1A--5.i. Specifically OPRA states that, "the requestor shall
be advised by the custodian when the record can be made available. If the
record is not made available by that time, access shall be deemed denied"

Your request requires an extension of time for 30 days until March 25th,
2020.

School Business Administrator/Board Secretary

Dear Mr. Jannarone,

On February 25, you requested an additional 30 days to respond to my OPRA request filed on February 12. I have not received any written responses since then and it is now April 8. Please advise when you can produce the requested records.

Yours sincerely,

Charlie Kratovil

Richard Jannarone, New Brunswick Board of Education

Pursuant to P.L 2020, c. 10, during a period declared pursuant to the laws
of this State as a state of emergency, public health emergency, or state of
local disaster emergency the custodian of a government record shall make a
reasonable effort, as the circumstances permit, to respond to a request for
access to a government record within seven business days or as soon as
possible thereafter. OPRA also allows the records custodian to seek
extensions of time pursuant to N.J.S.A. 47:1A-5.-i. Due to the current
disruptions to the District’s operations and closures from coronavirus, the
District anticipates requiring an extension of time until April 30, 2020 to
compile, review, and redact (if necessary) the potentially responsive
records in accordance with New Jersey law. The District also reserves the
right to request an additional extension of time, if necessary. See
Scheeler v. New Jersey Department of Educ., GRC Complaint No. 2014-123
(2016).
