The Township of Livingston’s Municipal Clerk's Department has reopened to the public and will respond to your email as soon as possible. However, if submitting an OPRA request or inquiring about a previously submitted OPRA request, please realize that pursuant to P.L. 2020 Ch 10, OPRA deadlines are inapplicable during a State of Emergency and that record custodians ”must make a reasonable effort, as the circumstances permit to respond to a request for a government record within 7 business days or as soon as possible."

Your request is too broad as you have not included the specific date or
range of dates during which the email(s) were transmitted.
In Elcavage v. West Milford Twp. (Passaic), GRC Complaint No. 2009-07
(April 2010). The Government Records Council determined that to be
valid, such requests must contain: (1) the content and/or subject of the
email, (2) the specific date or range of dates during which the email(s)
were transmitted, and (3) the identity of the sender and/or the recipient
thereof. See Elcavage, GRC 2009-07;
Please clarify the date or range of dates during which the email(s) were
transmitted.

Pursuant to your July 23, 2021 request under OPRA and the common law of
access for “All emails to and from Town Councilmen or Town Employees with
words “Playing Politics” in the subject line during the period of
September 1, 2019 to December 31 2019”, please see the attached emails
responsive to your request. In accordance with N.J.S.A. 47:1A-1.1,
unlisted phone numbers are exempt, and pursuant to N.J.S.A. 47:1A-1 “a
public agency has a responsibility and an obligation to safeguard from
public access a citizen’s personal information with which it has been
entrusted when disclosure thereof would violate the citizen’s reasonable
expectation of privacy”, and therefore certain emails have also been
redacted.
