Emails to and from officials in South River/South River EMS Inc.
Dear NJ Department of Health Division of Public Health Infrastructure, Laboratories and Emergency Preparedness,
This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:
A copy of all emails sent to your department from any officials from the borough of South River during 2018 and 2019.
A copy of all emails sent from your department to any officials from the borough of South River during 2018 and 2019.
A copy of all emails sent to your department from any officials from the South River EMS, Inc during 2018 and 2019.
A copy of all emails sent from your department to any officials from the South River EMS, Inc during 2018 and 2019.
Dear NJ Department of Health Division of Public Health Infrastructure, Laboratories and Emergency Preparedness,
The law required that you respond by yesterday. Please respond immediately with the requested information.
Dear Requestor:
The referenced request for "all e-mails" records between the entire Department and "any officials" is improper. The request is overbroad, nonspecific, and unduly burdensome in that it would require the custodian to:
• conduct research and exercise discretion;
• interview every current and former employee of the department for the specified period and know the identity of every "official" of Borough of South River and South River EMS, Inc. for the specified period, to determine if any one of these persons sent a "communication" to, or received a "communication" from, a department employee;
Therefore, the government records law, N.J.S.A. 47:1A-1 et seq., obliges me to deny the request. You have the right to appeal this determination in accordance with applicable law.
Sincerely,
Thomas A. Starr, MICP
