With regard to your OPRA request dated 2/18/20 and received on 2/19/20 for emails, please be advised of the following:

Your request for emails from 2012 is denied as per NJSA 47:1A-1.1, because no records exist. The records were destroyed in accordance with NJ State Statutes after receiving permission from the State of NJ to destroy them. A disposition form is attached.

Your request for emails from 2/19/2020 to 2/29/20 forward is denied as per NJSA 47:1A-1.1, because requestors cannot request records in advance of the records being created. You may re-request these records with a new OPRA request after the dates have occurred.

With regard to the remainder of your request, it is estimated that there are more than 500,000 documents responsive to your request. Each document must be compiled and reviewed for proper redactions by the proper employees pursuant to OPRA. It is predicted at this time that 6,000 hours of combined labor by Township employees will be required to fulfill your request, resulting in a substantial disruption of agency operations pursuant to NJSA 47:1A-5g. In an effort to reach a reasonable solution that accommodates the interests of both you and the Township you may provide additional parameters (i.e. reduce the time frame, provide content and/or subject matter, provide specified recipients of the requested e-mails, etc.) to reduce the number of responsive documents requiring review and redaction. This will likely reduce and may eliminate the substantial disruption caused by the volume of responsive records.

Please advise this office if you wish to provide additional parameters to your request in order to possibly alleviate the substantial disruption.
