The Board is in receipt of your Open Public Records Act request seeking “Intercommunication (emails, company messenger, texts) between board members Christine Skurbe and Karen Walka Bierman discussing board conduct, behavior, and ethics. Responsive records should include the timeframe of March 01, 2022 until the time of this dated request.” Your request requires further clarification. A proper request under OPRA must identify with reasonable clarity those documents that are desired. See Bent v. Stafford Police Department, 381 N.J. Super. 30, 37 (App. Div. 2005). In particular, OPRA “is not intended as a research tool litigants may use to force government officials to identify and siphon useful information. Rather, OPRA simply operates to make identifiable government records ‘readily accessible for inspection, copying, or examination.’ N.J.S.A. 47:1A-1.” MAG Entm't, LLC v. Div. of Alcoholic Beverage Control, 375 N.J. Super. 534, 543 (App. Div. 2005). Determining whether communications are discussing board conduct, behavior, and ethics would require the records custodian to read through every email and text message and make a discretionary determination on whether the e-mail was discussing the aforementioned general topics. As your request does not identify a specific government record, it is denied, at this time, until further clarification is provided.

Your request requires additional time to respond due to the significant demands placed on the District with regard to the COVID-19 pandemic, and OPRA requests. OPRA allows custodians to seek extensions of time pursuant to N.J.S.A. 47:1A-5(i). Specifically, OPRA states that “the requestor shall be advised by the custodian when the record can be made available. If the record is not made available by that time, access shall be deemed denied.” Accordingly, your request requires an extension of time until June 27, 2022.

Dear Anonymous,

 

The District is in receipt of your request for records under the Open
Public Records Act. Your previous request sought, "Intercommunication
(emails, company messenger, texts) between board members Christine Skurbe
and Karen Walka Bierman discussing board conduct, behavior, and ethics.
Responsive records should include the timeframe of March 01, 2022 until
the time of this dated request." This request was denied for failing to
identify a specific government record. Subsequently, the District received
the following request: "Text Messages and/or emails should have the
following words in subject line or in body of text: Ethics, undermine,
undermining, complaint, ethical, behavior." It is unclear whether this is
a new request or clarification to the prior request. If it is
clarification, the District remains unclear of the records that you are
seeking, as the first request and the new request provide different terms.
As the contents of the request are unclear, it is denied at this time,
until clarification is provided, such by including one request that fully
encompasses the records that you are seeking. If this is a new request, it
also requires further clarification. The Government Records Council
("GRC") has established specific criteria that must be met for a requestor
to identify specific government communications. The GRC determined that to
be valid, the request must contain: (1) the content and/or subject of the
communication, (2) the specific date or range of dates during which the
communications were transmitted, and (3) the identity of the sender and/or
the recipient thereof. Elcavage v. West Milford Twp., GRC Complaint No.
2009-07 (April 2010); Caggiano v. NJ Office of the Governor, Complaint No.
2014-263 (March 2015). Your request fails to provide the requisite
information to identify a specific government communication. As a result,
if it is a separate request, it also is denied, at this time, until
further clarification is provided.
