All Electronic mail ("E-mail") communications sent to, or received from, any and all cannabis cultivation/manufacturing/distribution applicants or potential applicants or persons/companies or their representatives who have applied for, or expressed an interest in, operating/owning/managing/hosting a cannabis cultivation/distribution or manufacturing business or operation within the Borough of West Cape May, Cape May County, NJ.
2. Above documents to include any and all attachments.
3. Above documents requested for the time period from January 1, 2021 to the present.

Mr. Rafone,
The Borough of West Cape May received your Open Public Records Act (OPRA)
request dated February 13, 2024. The official records custodian, Theresa
Enteado, received your OPRA request on February 14, 2024. I indicated I
needed additional time to identify and compile the records that you
requested, the response deadline was extended to March 27, 2023.
Attached you will find your original request, a zip file containing
records responsive to your request- some with redactions, as well as a
detailed privilege log.
(I had our IT department pull every email to and from every employee and
elected official of the Borough of WCM, which included the words cannabis
cultivation, distribution, manufacturing, as well as application requests
for cannabis operations, during the time period you requested, January 1,
2021 to present. Please note, a large percentage of the
emails/attachments being provided to you, in response to your request, are
not actual requests for cultivation, distribution, or manufacturing, but
rather the email or attachment contains one or more of those words. In
addition, I have not included any duplicate emails and/or attachments as a
result of an email being sent to and received by multiple email
addresses. This was done as a courtesy for your convenience.)
Pursuant to N.J.S.A. 47:1A-5.b., there is no cost for these documents, as
the response is being submitted to you via email.
If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the Borough of West Cape May to deny
access. At your option, you may either institute a proceeding in the
Superior Court of New Jersey or file a complaint with the Government
Records Council (GRC) by completing the Denial of Access Complaint Form.
