Please be advised that pursuant to regulation, N.J.A.C. 13:1E-2, submission of records requests by email to the Department of Law and Public Safety is not permitted. N.J.A.C. 13:1E-2.4(a) states: "Written Open Public Records Act (OPRA) requests shall be hand-delivered during normal business hours of the public agency, mailed or submitted electronically to the appropriate division or agency custodian of records over the Internet by means of a web-enabled OPRA request form [.] Submission of requests by e-mail or facsimile transmission is not permitted." Pursuant to this regulation, I am not able to accept your email as a valid OPRA request for access to government records.

You may instead submit your request through the State’s online form, located at: https://www-njlib.state.nj.us/NJ_OPRA/de.... Select "Law and Public Safety." Next, select "Division of Law." Alternatively, you may choose to mail in a written/paper request or mail in a completed records request form. I have attached a blank records request form. The mailing addresses for the Records Custodians of the Department of Law & Public Safety can be found on page 2 of the form.

Dear Records Law,

The regulation you cite applies to OPRA requests. Please provide the records under the common law. The interest in secrecy does not outweigh the public's interest in disclosure.

Records Law,

Dear Anon:

Please be advised that, to the extent you have requested these records under the common law right of access, your failure to articulate any interest in the records precludes the Division of Law from engaging in the balancing test articulated by Loigman v. Kimmelman, 102 N.J. 98 (1986). Therefore, your request is denied.
