Dear Monmouth County Prosecutor's Office,
This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:
Please send your response in PDF form.
A copy of the DWI Check Point Schedule for the year of 2020
Please include a Record Index with your response.
*A record index that identifies each record requested and the specific legal basis for a denial of access (including redactions) to each record.
Yours faithfully,
ASK NJ Media Co.
ASK NJ Media Co.:
We are in receipt of the below OPRA request of March 15, 2020 for "DWI Check Point Schedule for the year of 2020."
We received an identical request from you on March 3, 2020.
A timely response to the March 3, 2020 request would be due tomorrow, March 17, 2020. Because the two requests are the same, I am treating March 17, 2020 as our due date. Our response is set forth below:
When you requested the 2020 DWI checkpoint schedule in early February 2020, it had not yet been developed. I denied your request for that reason.
Last week, as the due date for your renewed request was approaching, I made inquiry about the status of the 2020 checkpoint schedule. I have been told that it has not been completed.
I have considered requesting an extension of our due date, so that I could provide you with the checkpoint schedule when it is finished, without the need for you to request it a third time. I am concerned, however, with the disruption to normal operations that may be occasioned by COVID-19. I do not know how the virus will affect the work schedules of the persons responsible for generating the checkpoint schedule. I do not know how much time to ask for in light of that uncertainty.
Therefore, your request for the "DWI Check Point Schedule for the year of 2020" is being denied, because this Office does not have a responsive record at this time. You are welcome to submit a new request at a later date.
Mary Juliano
Assistant Prosecutor
