Dear Requestor:
As previously advised, the Rowan University / Rutgers – Camden
Board of Governors (the “Board”) is in receipt of your request for
records, pursuant to the Open Public Records Act (“OPRA”) and common law
right of access, dated October 6, 2022 and received the same day. For
ease of reference, the Board notes that your request seeks access to the
following:
All RFP 2020-04 vendor-produced: design plans, development plans, campus
plans or any other plans, reports, models, status reports, meeting
minutes, presentations, renderings, findings, reports, or other
documentation produced in response to RFP-Urban-Planner-2020-04.
On October 21, 2022, the Board notified you that, as authorized
under OPRA, it required an extension to November 7, 2022 to review
responsive materials to ensure that all confidential, exempt, proprietary
or otherwise privileged information was appropriately redacted prior to
production. Please be advised that a request pursuant to OPRA must
identify the records sought with specificity. Bart v. Passaic County Pub.
Hous. Agency, 406 N.J. Super. 445, 451 (App. Div. 2009). OPRA “is not
intended as a research tool litigants may use to force government
officials to identify and siphon useful information.” MAG Entertainment,
LLC v. Division of Alcohol Beverage Control, 375 N.J. Super. 534, 546
(App. Div. 2005). A custodian may reject a request that is overly broad
or vague so as to prevent identification of the records sought. New
Jersey Builders Ass’n v. New Jersey Council on Affordable Housing, 390
N.J. Super. 166, 172 (App. Div. 2007), cert. denied 190 N.J. 394 (2007).
Redaction of records is appropriate to, among other reasons, protect a
reasonable expectation of privacy. N.J.S.A. 47:1A-1; 47:1A-5.
Additionally, communications which involve the deliberative process
privilege as containing “advisory, consultative and deliberative
communications” are not subject to disclosure under OPRA. N.J.S.A.
47:1A-1.1; Ciesla v. N.J. Dep’t of Health, 429 N.J. Super. 127 (App. Div.
2012).
Without waiving any of the above-mentioned exceptions and/or reasons for
non-disclosure of the information you seek in your request, and subject to
those exceptions and/or reasons, enclosed are documents responsive to your
request with redactions applied as stated above.
