DMR needs analysis
Dear Red Bank Borough,
This is a request for public records made under OPRA and the common law right of access.

The needs analysis for borough facilities completed by DMR for the Redevelopment Agency.

This email is to acknowledge receipt of your OPRA request dated 2/23/2021
and received via email on 2/24/2021. This response is being provided on
the second business day after the receipt of your request.
I have forwarded your request to the Attorney for the Redevelopment Agency
and have received the following response:
"This document is still under review and part of the deliberative process
by the Red Bank Redevelopment Agency and is therefore exempt from
disclosure under the terms of OPRA. Once the document becomes a public
record after the conclusion of the deliberative process by the
Redevelopment Agency the requested documents may be a public record that
should be provided under the terms of the Open Public Records Act."
To the best of my knowledge, no other records exist that would be
responsive to your request. If you are aware of a specific document that
you believe has been omitted, please clearly identify that record by name,
date and subject matter.
This will close this OPRA request.

I am renewing my OPRA request for the Needs Analysis completed by DMR for the Redevelopment Agency, since the deliberation process has finished.

I have reviewed your request with the Borough Attorney and the
Redevelopment Attorney and both maintain that this record is not
disclosable. Specifically, "the request for the Needs Analysis for Borough
facilities is still not disclosable as it is still under review by the
Redevelopment Agency and subject to the deliberative process exemption."
This will close this OPRA Request.
