Directive re: Voting Machine Tapes

Ocean County Clerk did not have the information requested.

Dear Ocean County Clerk's Office,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.

Background:
Louise Quist, who served as a district board worker in the 2019 general election at a polling place in Lacey Township, has claimed in a letter written in her official capacity dated December, 2019 that representatives of campaigns were not permitted to request copies of voting machine tapes following the close of polls "... as requested by the County Clerk."

Records requested:
I am requesting copies of any written directives, requests or policy statements issued by the office of the Ocean County Clerk pertaining to the release of voting machine tapes by Board workers for the period of January 1st, 2019 to November 5th, 2019.

Our office does not have any of the documents you requested in your OPRA request email due to the fact that the County Clerk has absolutely no statutory authority with regard to the supervision of Poll Workers or Polling Places. The Ocean County Board of Elections is responsible for the supervision of Poll Workers and Polling Places.
