Good morning,
The Borough of Spring Lake received your Open Public Records Act (OPRA)
request on January 15, 2019. As such, the seven (7) business day deadline
to respond to your request is January 24, 2019.
Your OPRA request sought access to the following: "copies of email logs
for the municipality's police chief from December 1, 2018 to December 7,
2018. Please include sender, recipient, date and subject."
Please see the Paff v. Township of Galloway Supreme Court decision from
2017, which held this is a valid request.
Your request requires additional time beyond the seven (7) business days
to fulfill it; the request requires me to obtain documents that are not on
location and our IT Company has to extract. OPRA allows custodians to
seek extensions of time pursuant to N.J.S.A. 47:1A-5.i. Specifically, OPRA
states that, “the requestor shall be advised by the custodian when the
record can be made available. If the record is not made available by that
time, access shall be deemed denied.” Your request requires an extension
of time until the information can be researched but not later than
February 8, 2019.
