Good afternoon:

You had submitted an Open Public Records Act (“OPRA”) request, which was
received by the Records Custodian on March 25, 2022.  Please accept this
letter as the Custodian’s response pursuant to OPRA.

Your request sought access to the following for 310 Palmer Road, 103 Cedar
Lake East and 5 Birch Run:

               *             Owners Information

               *             Recent Permit applications

               *             Contractor information related to recent
permit applications.     

Portions of your OPRA request is invalid under OPRA because it requests
information, not specifically identified government records. See, e.g.,
Wilcox v. Twp. of West Caldwell, GRC Complaint No. 2004-28 (Oct. 2004)
(finding a request for the identify of a zoning violation complainant
invalid under OPRA as a request for information, not access to a
government record).  OPRA does not require the Township to complete forms,
answer questions, or provide information.  See N.J.S.A. 47:1A-1; MAG
Entm’t, LLC v. Div. of Alcoholic Beverage Control, 375 N.J. Super.  534,
546, 549 (App. Div. 2005) (OPRA “is not intended as a research tool . . .
to force government officials to identify and siphon useful information.
Rather, OPRA simply operates to make identifiable government records
“readily accessible for inspection, copying, or examination”).   However,
the Township has conducted a search for the records you have properly
identified and encloses the following records believed to be responsive to
your request.

You can tell if a permit has been finalized by looking under the heading
"Close Dt".  If there is no date in that column, then the permit is still
open.  Any questions regarding open permits should be directed to the
Construction Department, 973-625-8300, #6.  Archived Permits – Redactions
have been made to phone numbers and SSNs pursuant to NJSA 47:1A-5.

There are no other records responsive to your OPRA Request. This request
is now deemed complete and closed.
