Dear Mr. Rodrick:

The Ocean County Board of Taxation received your Open Public Records Act (OPRA) request on April 9, 2020.

Your OPRA request sought access to “Email communications between the tax board and Toms River pertaining to the BASF, "Ciba Geigi" property in Toms River; Members of the Tax Board, Toms River elected officials, (past and present), it's legal team, and anyone employed or contracted by the township of Toms River that has communicated via email with the County Tax Board about the property specified above.”

Please accept this email as a reply to your recent request for government records. After a search of emails regarding your request, attached please find a copy of the correspondence between Ms. Christine Allen, Assistant Tax Administrator and Mr. Carl Dileo, Tax Collector for Toms River Township. (Please note, the Township has not provided us with the total loss as of yet so there has been no further email reply).

If your request for access to a government record has been denied or unfilled as required by law, you have a right to challenge the decision by the Records Custodian of the Ocean County Board of Taxation to deny access. At your option, you may institute a proceeding in the Superior Court of New Jersey. All questions regarding complaints filed in Superior Court should be directed to the Superior Court Clerk located in your County (and see www.judiciary.state.nj.us).

Alternatively, you may file a complaint with the Government Records Council (GRC) by completing a Denial of Access Complaint Form. You may contact the GRC by toll-free telephone at (866) 850-0511, by mail at P.O. Box 819, Trenton, NJ, 08625, by e-mail at [email address], or through their web site at www.state.nj.us/grc. The GRC can also answer other questions about the law.

Sincerely,

Chelsea Skuby
