Committee Materials – A1556/S901 (L.2022, c.96, New Jersey Antitrust Act amendments)

I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.

1. All written testimony submitted to the committees listed below concerning Assembly Bill 1556 (1R) / Senate Bill 901 (1R), 2022 session.
2. All witness lists or sign-in sheets maintained for these hearings.
3. Any staff bill memos or background briefing materials prepared by OLS staff for legislators in connection with these hearings.
This request is limited to the following hearings where the bills were considered:
- Assembly Consumer Affairs Committee (March 7, 2022, and May 9, 2022)
- Senate Commerce Committee (February 10, 2022)
- Senate Budget & Appropriations Committee (June 27, 2022)

You requested the following: “1. All written testimony submitted to

Personal email addresses, home addresses and phone numbers have been
redacted because they are exempt from public access pursuant to N.J.S.A.
47:1A-1.

Pursuant to N.J.S.A. 47:1A-1.1, “any memorandum, correspondence, notes,
report or other communication prepared by, or for, the specific use of a
member of the Legislature in the course of the member’s official duties”
is not considered to be a government record for which disclosure can be
compelled under OPRA. Consequently, this portion of your request is denied
on the basis that any responsive documents are excluded from the OPRA
definition of “government record” and are therefore exempt from
disclosure.
