Code Violations 3/2023 and Roll-Off Policies

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.

• Code Violations Log Report for violations issued between 3/1/2023 and 7/1/2023.
• All and all warnings, inspections, and violations/tickets & any payments for issued violations or tickets issued from March 1, 2023 through June 15, 2023.
• Copy of ordinance pertaining to roll-off dumpster policy, rules, permits, placement, and requirements as well as policy defining requirements regarding placement when standard off-street placement is deemed impossible due to site-particular circumstances or otherwise reasons establishing the necessity of street placement due to hardship or other reasons.

Good morning,
1. Code Violations Log Report for violations issued between 3/1/2023 and 7/1/2023.
1. RESPONSE I have attached our monthly report.
2. All and all warnings, inspections, and violations/tickets & any payments for issued violations or tickets issued from March 1, 2023 through June 15, 2023.
2. RESPONSE The attached monthly report indicates the violations. Any information regarding tickets and payments will have to be requested through the Municipal Court. I do not retain these records.
3. Copy of ordinance pertaining to roll-off dumpster policy, rules, permits, placement, and requirements as well as policy defining requirements regarding placement when standard off-street placement is deemed impossible due to site-particular circumstances or otherwise reasons establishing the necessity of street placement due to hardship or other reasons.
3. RESPONSE Code 9.16.020 references the obstruction of streets and sidewalks.
We do not have anything in place for a hardship.
As a side note, I have spoken with our new code enforcement officer and we are going to do a little research on how many properties would qualify for a hardship should they desire to rebuild or do a large gut job. We know there are a lot of very small properties in Ship Bottom. We MAY present (to the Mayor and Council) changing the code to accommodate such properties. Not something you requested but I feel the information may be useful to you given the nature of the request. Should you have any questions please do not hesitate to contact me at any time! I am always happy to answer any questions. I appologize for forgetting to fill your request. It was not done intentionally. We have been packing our office up along with trying to continue to run the office which is a pretty large task since we are the custodians of all records in the Borough (aside from the court office)

Mr. Keller,
In what capacity would you like an internal review to happen? We follow the state statute on OPRA. What is SUPPOSED to happen is:
I get a request and I have seven days from the date of receiving the request (day one is the day after I receive the request) and it does not include weekends or holidays.
Should I require more time, which happens often, I request it in writing. I am typically relying on other offices to get me the information so more time is needed.
Your request involved the Code Enforcement Officer. We have a new person in that position. The record keeping in that office was less than stellar, to be honest. The new person, Matt, is great and is working on learning a new system that will track a record of violations. The previous person, Bob, had a notebook with hand written notes which we cant seem to locate.
I just want to relay to you that your request was not purposefully ignored. It was an oversight on my part and I apologize for the inconvenience.
