Code Violation List Request
Dear Longport Borough,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL use the requested government records for a commercial purpose (Real Estate).
I AM NOT seeking records in connection with a legal proceeding.

Code Violation List Request for 07/21/2024 - 09/19/2024
I am kindly requesting a list of all code violations for all properties in the City during this time period, specifically related to property maintenance, structural issues, and weeds. Please include descriptions of the violations, property addresses and violation dates.
My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Thank you for your OPRA Request 2024-95. Once, again, I apologize for the delay. Thank you for bringing your request to my attention. Please note that the Longport Building Department has provided the attached record as possibly responsive to your request. The attached contains complaints received by the department. Please note that there are redactions per N.J.S.A. 47:1A-1 - Privacy Interest.
In the case of Perino v. Borough of Haddon Heights (Camden), GRC Complaint No. 2004-128. The Government Records Council (GRC) considered the request to the police department for a noise complaint filed against a homeowner. The GRC ruled:
1.The Complainant's stated need for access does not outweigh the citizen's expectation of privacy. In arriving at this conclusion, the potential harm of unsolicited contact and confrontation between the citizen and the OPRA complainant and/or its agents or representatives was considered. Therefore, the name, address and phone number of the citizen who brought the complaint to the Borough's attention should remain redacted from the requested documentation.
As a result, the information provided will have redacted the name of the person or persons who filed the complaint with the Borough per N.J.S.A. 47:1A-1 - Privacy Interest.

At your option, you may either institute a proceeding in the Superior Court of New Jersey or file a complaint with the Government Records Council (GRC) by telephone at 866-850-0511, by mail at P.O. All questions regarding complaints filed in Superior Court should be directed to the Court Clerk in your county.
