Code Enforcement Photos of Leaf Violations
Dear Ridgewood Village,
This is a request for public records made under OPRA and the common law right of access. I certify under penalty of NJSA 2C:28-3 that I have not been convicted of an indictable offense. Please acknowledge receipt of this message.
Records requested:
1 - Copies of all photographs taken by the Code Enforcement department of the Village of Ridgewood or the Village's leaf collection contractor of leaf violations at 320 Hamilton Road from October 25th, 2017 to November 25th, 2017.
2 - Copies of all photographs of leaf violations taken by the Code Enforcement department of the Village of Ridgewood or the Village's leaf collection contractor of all residences located on Parsons Road from October 25th, 2017 to November 25th, 2017.

under OPRA Exemption N.J.S.A. 47:1A - Ongoing investigations – any records
pertaining to an investigation in progress by any public agency if
disclosure of such record or records shall be detrimental to the public
interest. This provision shall not be construed to allow any public agency
to prohibit access to a record of that agency that was open for public
inspection, examination, or copying before the investigation commenced.
You may submit a request for these documents to our Municipal Court with:

Dear Donna Jackson,
What is the investigation that is still in progress? As I understand it, the code violation summonses have already been issued to these residences and a court date has been scheduled, so these photos should be releasable to the extent that they depict properties that have already received a summons.
I am not requesting municipal court records, I am requesting records that were made, maintained, kept on file by the Ridgewood code enforcement department to support their findings of violations about the properties that were the subject of this request.

Since the matters have not yet been decided in Court and the disposition of the violation is subject to appeal, the information is still an on-going matter.
