Code Enforcement
Dear Red Bank Borough,
This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:
Any and all code enforcement complaints relating to "overcrowded", meaning complaints where the complainant reported a number of residents in a property that appeared to have more residents than allowed according to Borough zoning regulations complete with dispositions and all investigatory records, dispositions, and enforcement actions from 1/1/2015 to 6/3/2019. Additionally, please provide all communications related to overcrowding policies in the Borough and on those specific complaints.

This email is to acknowledge receipt of your OPRA request dated and
received via email on 6/4/2019. This response is being provided on the
seventh business day after the receipt of your request.
Attached please find document(s) in response to your recent OPRA request.
In your request, you also listed "dispositions and all investigatory
records, dispositions, and enforcement actions." I believe these records
are held by the Municipal Court. The judiciary is not subject to OPRA. I
have attached a New Jersey Judiciary Request form for your convenience if
you would like to request records from the Municipal Court.
To the best of my knowledge, no other records exist that would be
responsive to your request. If you are aware of a specific document that
you believe has been omitted, please clearly identify that record by name,
date and subject matter.
This will close this OPRA request.
Dear Pam Borghi,
"Investigatory Records" relating to those homes disposed as "unfounded" would not be with the judiciary but would be held within Code Enforcement. If there was no action taken, those records would not be sent to judiciary. Please fulfill this request or request a 7 day extension but those records are maintained at code enforcement. Some of those records that would generally be understood to be included in "investigatory records" would be notice to homeowner of inspection, inspection reports, etc.
Please turn over documents IMMEDIATELY or request an extension.

I had "closed" your original request so will log this in as a "new"
request. While "investigatory records" does not identify a specific
record, I will forward this to our Code Enforcement Department for "notice
to homeowner of inspection" and "inspection reports" which were specified
in your request. I will also use the date range from your earlier
request. I will respond within seven business days.
