N.J.A.C. 6A:28-6.6(g) requests that the School Ethics Commission hold all
information confidential regarding any pending matter until the Commission
finds that a school official has violated the Act, or until the matter is
settled, withdrawn, or dismissed. Accordingly, your request is denied.

 

A receipt indicating same, is attached.

Dear OPRA Custodian,

I believe this OPRA request was denied in error because your office has released multiple probable cause notices in the past. Perhaps, this inconsistency is due to a recent change in leadership at the School Ethics Commission. These cases are no longer pending before the School Ethics Commissions--they are now pending before the Office of Administrative Law. I believe the public is entitled to these probable cause notices generated by the School Ethics Commission. Good afternoon,

The applicable regulation, N.J.A.C. 6A:28-6.6(g), was recently changed. It previously stated, "The School Ethics Commission shall hold all information confidential regarding any pending matter until it first takes action at a public meeting to determine probable cause, or violation, or until the matter is settled, withdrawn or dismissed." Therefore, records could be released once the Commission took action to determine probable cause. However, the regulation now states, "The Commission shall hold all information confidential regarding any pending matter until the Commission finds that a school official has violated the Act, or until the matter is settled, withdrawn or dismissed." Accordingly, records can no longer be released following the probable cause determination.
