BRRSD Potential Lack of OPMA Awareness
Dear Bridgewater-Raritan Board of Education,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
Under the Open Public Records Act (OPRA), I request the following: (1) All records, correspondence, or documentation explaining the reasons for the BRRSD superintendent’s deletion of official Board of Education meeting videos from the district’s YouTube channel or other public platforms; (2) Any communications, memos, or legal opinions involving the superintendent, district counsel, or district staff regarding awareness of or compliance with the New Jersey Open Public Meetings Act (OPMA), such as N.J.S.A. 10:4-14, which requires that minutes or records of public meetings remain promptly available to the public, including whether such videos are considered part of the official record.
My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.
Yours faithfully,
Mr. Cyprian
Good morning,
In response to your OPRA request dated 4/8/2025. Your requests are denied
as they are overly broad for seeking “all records” regarding a topic
rather than specifying a specific record. Additionally, your request
seeks correspondence without identifying the specific accounts to be
searched and date range, as required by N.J.S.A. 47:1A-5. Your request
also appears to seek records that, if they existed, would be except as
advisory consultative and deliberative materials pursuant to N.J.S.A.
47:1A-1.1. Finally, your request seeks records that, if they existed,
would also clearly be covered by the attorney-client privilege and would
therefore be exempt from disclosure pursuant to N.J.S.A. 47:1A-1.1.
Thank you,
Kevin Lomski
