Good morning, the Authority is in receipt of your OPRA request and common law right of access request seeking “all documents relating to received bids and/or bid tabulations, including all quantities and unit pricing, for Atlantic City Expressway 2022 Bridge Rehabilitation.” At this time, the Authority will be rejecting all bids submitted for this Project. As such, your request is denied because the release of such would provide an advantage to competitors or bidders because the Board for the Authority has yet to vote on this Project and the Governor’s veto period has not ended. See Barth v. Rutgers, GRC Complaint No. 2017-21 (Final Decision dated June 25, 2019), (the GRC found that “[i]n a situation where a requestor sought access to bids during the selection process, the Council has determined that same are exempt from disclosure under” the exception that “[a] government record shall not include the following . . . information which, if disclosed would give an advantage to competitors or bidders.”); See also N.J.S.A. 47:1A-1; Renna v. Cnty. of Union, GRC Complaint No. 2003-100(February 2004); Fisher v. Lakewood Bd. of Educ. (Ocean), GRC Complaint No. 2006-193 (Interim Order dated June 27, 2007); and Bond v. Borough of Washington (Warren), GRC Complaint No. 2009-324(Final Decision dated March 29, 2011).
