Ms. Baisley:

The Legal Department has advised that pursuant to the definition of a Government Record, a State Agency does not have to provide a record that does not exist or create a record in response to requests. This was recognized by the court in Mag Entertainment, LLC v. Division of Alcoholic Beverage Control, 375 N.J. Super 537 (App. Div. March 2005).
