Bid Tabulation Results for 2020 Passaic Co Road Resurfacing Program
This is a request for public records made under OPRA and the common law right of access. Please acknowledge receipt of this message.

OPRA provides overriding public policies in the legislative findings (N.J.S.A. 47:1A-1) which must be considered during the handling of all OPRA requests for access to government records. Those public policies are:
- Government records must be readily accessible for inspection, copying, or examination by its citizens, with certain exceptions, for the protection of the public interest.
- Any limitations on the right of access to government records must be interpreted in favor of the public’s right of access.
- A public agency has a responsibility and an obligation to protect a citizen’s personal information that is in the possession of a public agency when disclosure of that information would violate the citizen’s reasonable expectation of privacy.
Therefore, at your soonest convenience please include a typed bid tally for this request at your soonest convenience. Thank you

Please inform the requestor that OPRA does not condone a creation of a record. The requestor received the documents requested, and his additional request "include a typed bid tally" does not fall under the definition of a government record. Pursuant to the definition of a Government Record, a State Agency does not have to provide a record that does not exist or create a record in response to requests. This was recognized by the court in Mag Entertainment, LLC v. Division of Alcoholic Beverage Control, 375 N.J. Super 537 (App. Div. March 2005).
