I am the Borough Attorney for the Borough of Paramus and accordingly am in
receipt of your email requesting "Bid Tabulation for Memorial School
Safety Improvements" to be typed out on sheets you provided to the Borough
Clerk.
As I understand it, you requested certain information about bid
tabulations which the Clerk provided to you, in the format in which the
records are maintained, in a timely manner. You were apparently not
satisfied with the Borough's response and sent a follow up email seeking
to have the Borough input the information on a form you provided. The
email you sent states:

Please be advised that OPRA defines a government record
in N.J.S.A. 47:1A-1.1 as the following:
“any paper, written or printed book, document, drawing, map, plan,
photograph, microfilm, data processed or image processed document,
information stored or maintained electronically or by sound-recording or
in a similar device, or any copy thereof, that has been made, maintained
or kept on file in the course of his or its official business by any
officer, commission, agency or authority of the State or of any political
subdivision thereof, including subordinate boards thereof, or that has
been received in the course of his or its official business by any such
officer, commission, agency, or authority of the State or of any political
subdivision thereof, including subordinate boards
thereof.” N.J.S.A. 47:1A-1.1."
Therefore, your request does not fit the definition of a government
record. In addition, OPRA does not require the Custodian of Records to
create a record that is not in existence, which is essentially what you
are requesting.
For the above reasons, the Borough considers your request to have been
complied with.
