Thank you for your response. The only thing I cannot locate within it is the "department/division" for each employee. Kindly provide that information.
Additionally, I would urge you to reconsider the statement that the information requested in items #4 and #6 is "NOT AVAILABLE." In response to identical requests, several Middlesex County municipalities have already provided that exact information about their local governments. I would respectfully request that your office produce this information about Plainsboro. Thank you again.

I was advised by the Township Clerk's office that I did not need to create a document if none currently exists. In a subsequent email to you I clarified that "not available" meant that there was not an existing document which contained the information you requested. While other municipalities may have this information in a document, Plainsboro Township does not. Additionally there is not a document that lists each employee's department/division. I will double check with the Township Clerk's office to clarify what is required if a document does not exist, but my understanding was that I do not need to create documents.

Dear Ms. Shinn,
I write to respectfully request that your office reconsider the decisions made in response this request.
While your associate cites case law from 2005 regarding the definition of a government record, it's important to note that OPRA was amended in 2010 and the current version explicitly states "an individual's name, title, position, salary, [and] payroll record... shall be a government record."
Further, the NJ Supreme Court has since ruled in Paff v. Galloway that, "With respect to electronically stored information by a municipality or other public entity, we reject the Appellate Division s statement that OPRA only allows requests for records, not requests for information. Paff, supra, 444 N.J. Super. at 503 (quoting Bent, supra, 381 N.J. Super. at 37). That position cannot be squared with OPRA's plain language or its objectives in dealing with electronically stored information."
Regarding item #4, I have made this request of dozens of government entities and Plainsboro is the only municipality that has declined to provide the information. Further, the very same section of OPRA cited above also explicitly states that "the amount and type of any pension received shall be a government record."
Item #6 of my request is simply requesting payroll records that would show how much each employee was paid in 2018. I believe that Plainsboro is able to produce this type of report with relative ease. Similarly, these records have been provided upon request on a wide scale by other municipal governments throughout Middlesex County.
Please reconsider and provide records, reports, lists, documents, statements that would satisfy items #4 and #6 of my January 6, 2019 request.
