Dear Mr. Buchansky:
Please accept this correspondence in reply to your recent request for
records. Specifically, you submitted a request through OPRA Machine for
“MERS Backpack System Email List,” which constitutes the email addresses
of parents or guardians of current District students. Such information is
obtained by the District for the purpose of communication with
parents/guardians about their children and school-related matters.
OPRA provides that a public entity cannot produce a record when a
citizen's personal information with which the public entity has been
entrusted when disclosure thereof would violate the citizen's reasonable
expectation of privacy. See Burnett v. County of Bergen, 198 N.J. 408
(2009). Parents and guardians who submit their personal email addresses
to the District have an expectation that those email addresses will not be
subject to public inspection or release pursuant to OPRA.
Additionally, OPRA specifically protects as confidential any record
otherwise protected by law, rule, or regulation. N.J.S.A. 47:1A-9. In
that regard, the record you request is protected by regulations of the
Department of Education pertaining to student records, including, but not
limited to N.J.A.C. 6A:32-7.1 et seq.
Accordingly, because parents and guardians have a reasonable expectation
of privacy that their email addresses are not open to the public and are
otherwise protected by the New Jersey Administrative Code, the District
cannot produce those records as you requested.

Thank You for your response. In looking further into your denial i feel that this needs to be challenged. The cases that you are referencing does not equate to the response.
I am not making a request for actual names of people in which your response is stating we are. Regarding Burnett V County in 2009, the Supreme Court issued Burnett v County of Bergen, its first opinion analyzing OPRA's privacy provision. In Burnett, the court was faced with a request that sought access to millions of records which contained names, addresses and social security numbers. My request does not follow this precedence.
What i will refer you to is Middletown committeeman Tony Perry where his list of resident's email addresses were obtained correctly and the town of Middletown had to legally provide this information.
