The Monmouth County Prosecutor's Office is in receipt of the below public
record request.

Attached please find a copy of the crash report.  Driver's license numbers
have been redacted pursuant to N.J.S.A. 47:1A-5.  Registration numbers
have been redacted as a "confidential personal identifier" in accordance
with R. 1:38-7(a) and N.J.S.A. 47:1A-9.

Our file does not presently contain reports, BAC reports, toxicology
reports, arrest reports or CAD entries.  Your request for those documents
is denied on the ground we do not have them to provide.

The motor vehicle collision that is the subject of your request is under
open investigation by this office for possible criminal charges.  To the
extent that we do have photos, statements, reports, or documents pertinent
to scene investigation, they would be exempted from disclosure as
"criminal investigatory records."   N.J.S.A. 47:1A-1.1; see North Jersey
Media Group, Inc. v. Township of Lyndhurst, 229 N.J. 541, 569 (2017)
(investigative reports and witness statements about criminal incident
"fall within the 'criminal investigatory exception'"); Serrano v. South
Brunswick Twp, 358 N.J. Super. 356-57, 360, 370 (App. Div. 2003)
(affirming dismissal of portion of complaint regarding non-disclosure of
police and EMT reports, on the ground such documents were "criminal
investigatory records"); cf. North Jersey Media Group, Inc. v. Township of
Lyndhurst, 441 N.J. Super. 70, 107 (App. Div. 2015) (noting records
generated that pertain to criminal investigation of collision would
qualify as "criminal investigatory records," but excepting 9-1-1 call and
crash report as both are required by law to be maintained), rev'd on o.g.,
229 N.J. 541 (2017).  The request for their disclosure is denied on this
ground as well.
