Attorneys bills for Independent Investigation
Dear Wayne Board of Education,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
1) Copies of all bills from the Attorney(s) hired to do an independent investigation relating to a dispute between Board members Battershill, Wentink, Rigoglioso and others which resulted after the issuance of a "Cease and Decease" letter to Ryan Battershill and Jennifer Battershill and is described in this article at this link:
https://www.tapinto.net/towns/hawthorne/...
2) Copies of all bills relating to ethics complaint defense for any ethics complaints filed against any members of the Wayne Board of Education from January 1, 2024 to present.
My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.
Yours faithfully,
Michael Gottesman, Founder NJPEC
Dear Wayne Board of Education,
On November 6, 2024, the OPRA request below was sent to your offices by email.
On November 15, 2024, I sent an email directly to the Board President Donald Pavlak inquiring whether the request would be satisfied by the statutory deadline. President Pavlak did not respond.
A response was required in accordance with the OPRA law by November 18, 2024. You have failed to respond.
You are now in violation of 47:1A-5.h.(1). which states "If a New Jersey public agency fails to respond to an Open Public Records Act (OPRA) request within seven business days, the request is considered denied."
Therefore you leave me with no option but to: 1) File a complaint with the Government Records Council (GRC) or file a lawsuit in Superior Court.
Either of these action, caused by your failure to respond, will result in unnecessary waste of Wayne Taxpayer school budget dollars.
I will hold off on filing for relief until Thursday, November 21,2024 at 5:00 PM. If no response is received by then, I will seek relief with no further notification to you.
Sincerely,
Michael Gottesman, Founder NJPEC
