Moreover, the incident reports are criminal investigatory records exempt from disclosure under OPRA. Pursuant to N.J.S.A 47:1A-1.1, a Criminal Investigatory Record is a record which is not required by law to be made, maintained or kept on file that is held by a law enforcement agency which pertains to any criminal investigation or related civil enforcement proceeding. O'Shea v. Twp. of W. Milford, 410 N.J. Super. 371, 380, 982 A.2d 459, 464 (App. Div. 2009).
Also, this is a DV so most documents related to this case will be protected by N.J.S.A. 2C:25-33.
