Attached please find a redacted copy of the arrest report. Also attached, is a redacted copy of the incident report. As per the Police Department, the incident report details a driving while intoxicated (DWI) arrest which ultimately resulted in an aggravated assault on a police officer. As per Blue v. Wall Twp. Police Dep’t. GRC Complaint No. 2002-47 (August 2003): Title 39 motor vehicle offenses such as a DWI are not a “crime”. Therefore, police investigations of such offenses are accessible under OPRA and are not a “criminal investigatory records” exempt from access pursuant to N.J.S.A. 47:1A-1.1. The redactions made pertain to the aggravated assault which is exempt from discloser as “criminal investigatory records.” There is no mugshot on file.
