Dear Colts Neck Township School District,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

1) Any and all documents associated with the planning or actual execution of the "History Rocks" Assembly including the visit from US Secretary of Education Linda McMahon which took place at the Cedar Drive Middle School in Colts Neck NJ on December 5, 2025.

2) Any and all documents relating to the cancellation of the scheduled Colts Neck Board of Education meeting on December 3, 2025 including but not limited to the reasons for cancellation of the meeting and the public notice given when the meeting was canceled. if notification was given by email, include documents showing the date and time stamp.

3) Any and all documents relating to the scheduling of a special Colts Neck Board of Education meeting on December 5, 2025 at the Cedar Drive Middle School including but not limited to all public notices of the meeting that were given. If notification was given by email, include documents showing the date and time stamp.

4) Any and all documents relating to the special Colts Neck Board of Education meeting on December 5, 2025 including but not limited to the agenda for the meeting, minutes and notes taken of the meeting, any transcription of the meeting, a recording of the meeting either audio, visual or both, any actions or resolutions taken at the meeting.

5) Any and all documents relating to the denial by the Colts Neck Board of Education and Superintendent of Schools Dr. MaryJane Garibay to allow parents to attend the public meeting and the reasons for the denial.

6) Any and all documents relating requests for and responses to requests from members of the public to be provided with a) copies of any materials distributed to students during the History Rocks Assembly, b) Audio or visual materials used during the History Rocks Assembly and c) the qualifications of any person who took place in the assembly or presented at the assembly.

7) Any and all documents relating to the denial by the Colts Neck school District, Colts Next Superintendent Dr. MaryJane Garibay or Colts Neck Board of Education to allow parents to attend the History Rocks Assembly.

8) Any and all documents relating to the limitation of journalists could attend the special board meeting or history rocks assembly to 4 local journalists.

For the purposes of this request, the term “document” includes, without limitation, any written, printed, typed, recorded, or graphic matter of any kind, however produced or reproduced, whether in hard copy or electronic format. This includes, but is not limited to, correspondence, memoranda, reports, emails, text messages, instant messages, voice mails, meeting minutes, notes, calendars, schedules, spreadsheets, Word documents, PDFs, presentations, photographs, videos, and any attachments, metadata, or embedded information contained therein.

The term “document” also encompasses drafts, preliminary versions, and any copies that differ in any way from the original, and any document stored on personal, mobile, or cloud-based devices if used for public business or maintained by a public agency.

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Dear Anne Marie Rizzuto,

In your previous email you indicated that the response to my OPRA request would be sent by January 7, 2026. I have not received it and we are past that date.

The district is now in violation of the Open Public Records Act.

Failure to respond by Monday, January 12 12, 2026 will force me to register a "Denial Of Access Complaint" with the Government Records Council.
