Dear Anonymous:

This office has consulted with the office of the Township Solicitor and it is requested that you modify your OPRA request or submit a new OPRA request that avoids the following issues:

1. Your request for all “communications” is denied unless modified, on the basis that such are not a specific government record. You must specifically identify a government record or records for any search. Please modify or submit a new OPRA request to identify the type of records you are seeking. If you want emails and memos, please state that.
2. The request for “all township departments” appears to be overbroad and burdensome. Minimally, this will require a survey of every department employee, depending upon with type of record sought. If you want emails, this will require searching of every email account in every department. This could result in a substantial disruption of Township operations. Please modify to limit the breadth. A sender and recipient should be specified.
3. The request for unspecified documents “regarding communications, press releases and social media” is also overbroad and burdensome. The subject or topic should identify a particular event(s) or matter(s).
4. The request, even if modified, may require an outside IT vendor to search every email account in every department for a subject line that contains the words: “communications, press releases and social media”. It is unknown at this time if such a search can be conducted without a recipient and sender name. It is unknown at this time what the cost of an IT consultant will be.
5. If a modified request produces actual government records, depending upon the breadth of the result, the Township Solicitor may be required to expend hours of legal assistance. We cannot access this until the request is modified and the records are produced.
6. Overall, if the request is not modified or articulated further, this request may not be able to be fulfilled as written for all the above reasons.

In an effort to address your request, please note that many items that might be considered as “communications, press releases and social media” actually exist on the Township’s website and the Township’s various social media outlets.
