Dear Middlesex Borough,
Under OPRA and the common law right of access, please provide a copy of the 2024 meeting schedule for the governing body, and for each board, commission, committee, or other municipal agency that holds public meetings, including but not limited to planning board, zoning board of adjustment, redevelopment agency, housing authority, utilities authority, parking authority, traffic commission, rent control/leveling board, environmental commission, shade tree commission, and open space committee.
If the schedules are unclear about the location/method(s) of meeting, I kindly ask that you clarify for me how to join and participate, and feel free to share links that can help members of the public to join and/or watch the meetings, or to watch them after they conclude.
If a particular schedule is not yet available at this time, please send what you can as soon as possible, and provide the outstanding schedule when it becomes available.

Dear Charlie Kratovil,
The Borough of Middlesex received your Open Public Records Act (OPRA) request on January 2, 2024. The official Records Custodian, Linda Chismar, received your OPRA requests on January 2, 2024. As such, the seven (7) business day deadline to respond to your requests is January 11, 2024. This response is being provided to you on the 2nd business day after custodian’s receipt of said request.
Your request sought access to the following:
1) Please provide a copy of the 2024 meeting schedule for the governing body, and for each board, commission, committee, or other municipal agency that holds public meetings, including but not limited to planning board, zoning board of adjustment, redevelopment agency, housing authority, utilities authority, parking authority, traffic commission, rent control/leveling board, environmental commission, shade tree commission, and open space committee.

Please note the following:
In addition, please be advised that regarding item #3, the request to provide the meeting schedule(s) “when it becomes available” is denied. OPRA does not require the custodian of records to supply records on a continuous or ongoing basis beyond what is currently available. Accordingly, the records provided consist of those that are available and responsive to your request at this time. See Blau v. Union Cnty. Clerk, GRC Complaint No. 2003-75 (January 2005) “[t]he request for copies on a continuing basis is not valid under OPRA”). See also, Paff v. Neptune Twp. Hous. Auth. (Monmouth), GRC Complaint No. 2010-307 (Interim Order dated April 25, 2012) (holding that if the complainant wanted access to approved meeting minutes, he would have to submit a new request after the minutes were approved).
