111 8th Ave
Dear Seaside Park Borough,
This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:
-All planning board decisions that involved Thomas Mianulli while he served as a Seaside Park planning board member.
-Dates Thomas Mianulli served on the Seaside Park planning board.
-The oath of Thomas Mianulli as an appointed planning board member.
-Thomas and Tracy Mianulli’s building/construction permit applications, inspections, approvals, variances requests, annual rental applications and inspections for their weekly summer rental scheme. As well as, zoning, building, and/or code violation letters for 111 8th Ave, Seaside Park.
-Tax assessments for 111 8th Ave, Seaside Park.
-Clark Motley’s planning board application and decision, and lawsuit regarding 211-213 O St, Seaside Park.
-Any variance request for single-family homes to increase to multi family homes within the town.
-Any planning board decisions to change/increase the structure of a preexisting non conforming property within the town.
-Any violations and planning board decisions for building a structure without a permit within the town.
- Varience applications and decisions pertaining to inadequate parking for their building structure within the town.
- Any variance applications, decisions, and violations regarding decks, lighting fixtures, structures within the 5 foot side setbacks within the town.
-Any code violation for residents for living in a home without a certificate of occupancy within the town.
Yours faithfully,
A concerned taxpayer regarding the egregious behavior by an appointed Seaside Park planning board member (Thomas Mianulli). Background information: Thomas Mianulli had a pre-existing non-conforming home that was destroyed by hurricane Sandy in 2012. While Thomas Mianulli served on the Seaside Park planning board, Seaside park aggressively went after another homeowner (Clark Motley 211-213 O St) for a similar situation where his pre-existing nonconforming property was destroyed and Seaside Park refused to allow the homeowner to rebuild his pre-existing nonconforming home. Therefore, losing his grandfather two family property status. This was heard in the N.J. appellate division who sided with the town. (See more here: https://www.foxrothschild.com/publicatio...). Thomas Mianulli tore down his damaged pre-existing nonconforming back house and rebuilt it without obtaining a permit (in 2015/2016). In utter disbelief, the town did not find this out until 2019. The Mianulli’s rent out this home for money. They have not applied for annual rental certificate of occupancy permits (ever). This home does not have any permits and/or inspections and therefore remains an unsafe structure as per N.J. Stare Law. Their tenants continue to live in an unsafe home which the town is aware. The Mianulli’s have not reported their rental income and therefore do not pay taxes on same. The Mianulli’s property hasn’t been assessed properly by the tax assessor and therefore they are not paying their fair share. This situation has been reported to Seaside Park in 2019. To date, the Mianulli’s continue to have multiple zoning and building violations. Their tenants continue to reside in the unapproved, uninspected, unsafe back home. The lies and deceit of an appointed planning board member is concerning. Allowing The Mianulli’s to keep their home while denying Clark Motely’s application for a similar matter should be viewed as corruption. Allowing one resident who is an appointed member of the planning board to keep their house and deny another resident with no connections to the town is concerning. This corruption should not be acceptable to the town nor the state of N.J. Thomas Mianulli may have used his appointed position of power to gain trust, all while denying other residents of same. This matter should be heard in another jurisdiction to ensure fairness and justice. To allow this matter to go in front of the same planning board/town council in which Thomas Mianulli served is a clear conflict of interest. If this matter is not heard properly it could have grave consequences later on. Anyone would be able to build anything on their properties (despite zoning) without a permit and cite this specific situation when asking for “forgiveness”. In addition, many residents who were denied could sue for damages. Choose wisely as this matter will set the tone for many years to come.
Dear Seaside Park Borough,
Following up again on this request. Tomorrow is the deadline. Would like to know where the town stands. There is no reason to deny the requested records. I’ve noticed someone requested records after this request and have already received them. Please provide the requested information as required by law.
Yours faithfully,
Concerned

Dear Seaside Park Borough,
This is a request for public records made under OPRA and the
common law right of access. I am not required to fill out an
official form. Please acknowledge receipt of this message.
Records requested:
-All planning board decisions that involved Thomas Mianulli while
he served as a Seaside Park planning board member.

-The oath of Thomas Mianulli as an appointed planning board
member.
-Thomas and Tracy Mianulli’s building/construction permit

letters for 111 8th Ave, Seaside Park.
-Tax assessments for 111 8th Ave, Seaside Park.
-Clark Motley’s planning board application and decision, and
lawsuit regarding 211-213 O St, Seaside Park.
-Any variance request for single-family homes to increase to multi
family homes within the town.
-Any planning board decisions to change/increase the structure of
a preexisting non conforming property within the town.
-Any violations and planning board decisions for building a

-Any code violation for residents for living in a home without a
certificate of occupancy within the town.
Yours faithfully,
A concerned taxpayer regarding the egregious behavior by an
appointed Seaside Park planning board member (Thomas Mianulli).
Background information: Thomas Mianulli had a pre-existing
non-conforming home that was destroyed by hurricane Sandy in 2012.
While Thomas Mianulli served on the Seaside Park planning board,
Seaside park aggressively went after another homeowner (Clark
Motley 211-213 O St) for a similar situation where his
pre-existing nonconforming property was destroyed and Seaside Park
refused to allow the homeowner to rebuild his pre-existing
nonconforming home. Therefore, losing his grandfather two family
property status. This was heard in the N.J. appellate division who
sided with the town. (See more here:
[11]https://www.foxrothschild.com/publicatio...).
Thomas Mianulli tore down his damaged pre-existing nonconforming
back house and rebuilt it without obtaining a permit (in
2015/2016). In utter disbelief, the town did not find this out
until 2019. The Mianulli’s rent out this home for money. They have
not applied for annual rental certificate of occupancy permits
(ever). This home does not have any permits and/or inspections and
therefore remains an unsafe structure as per N.J. Stare Law. Their
tenants continue to live in an unsafe home which the town is
aware. The Mianulli’s have not reported their rental income and
therefore do not pay taxes on same. The Mianulli’s property hasn’t
been assessed properly by the tax assessor and therefore they are
not paying their fair share. This situation has been reported to
Seaside Park in 2019. To date, the Mianulli’s continue to have
multiple zoning and building violations. Their tenants continue to
reside in the unapproved, uninspected, unsafe back home. The lies
and deceit of an appointed planning board member is concerning.
Allowing The Mianulli’s to keep their home while denying Clark
Motely’s application for a similar matter should be viewed as
corruption. Allowing one resident who is an appointed member of
the planning board to keep their house and deny another resident
with no connections to the town is concerning. This corruption
should not be acceptable to the town nor the state of N.J. Thomas
Mianulli may have used his appointed position of power to gain
trust, all while denying other residents of same. This matter
should be heard in another jurisdiction to ensure fairness and
justice. To allow this matter to go in front of the same planning
board/town council in which Thomas Mianulli served is a clear
conflict of interest. If this matter is not heard properly it
could have grave consequences later on. Anyone would be able to
build anything on their properties (despite zoning) without a
permit and cite this specific situation when asking for
“forgiveness”. In addition, many residents who were denied could
sue for damages. Choose wisely as this matter will set the tone
for many years to come.
